"Well, let's say that I drew some really awesome picture of two anime characters in a totally original situation that took days to do.
Now I want to make it into a poster and sell it for real money.

I also have a shop where I sell anime characters rendered into eggs -points to signature- and would love to sell those as well.

Discussion Questions:

[+] Do you think fanart is sellable?
[+] What about fanart of characters rendered in a totally original way? (as in like the form of cats, eggs, etc.)

It's not legal to sell it unless the characters in it are all your own.

i wonder about this myself... cause at cons you can sell fanart. i did this summer.. so did a lot of the artists. so i don't know if there was a loop hole or something.. maybe cause it was a convention, and it's assumed that it's not your characters.

so....it's possible to sell fanart... how far you go with it to the extent where it's illegal.. i don't know.

..and of course claiming characters that aren't your own is a given illegality =0=

I believe the rule is that it is legal, as long as you don't claim the character as your own. No one will sue you, if that's what you're worried about, unless you're making at least several thousand dollars a year off of all of it.

It's not legal on gaia (for real money or otherwise)
It's also not legal to take any copyrighted material and make any form of monotary gain off of it without the permission of the copyright owner.

HOWEVER if your just selling to say friends, or online for small amounts, it still isn't legal... however it's highly highly unlikely that any cmopnay will come after you in court as there more concerned with mass production, or those gaining large sums of money off there characters.

It's actually just not legal, period. Your right though that it's not likely anyone would sue unless you where making a large amount of gain.

Technically, selling fanart is NOT legal. Anywhere.

Xcept at cons, people still do so because the fanart of that anime was not "licensed" in America.. or so they say. xD It's an interesting concept... Conventions...
But still, you better not claim the character as your own and give credit to the original artist, and the artwork better not be similar to any previously drawn image by the original artist.
